Boulder Revised Code - Ordinances Pending Codification

Ordinances listed below have been passed by the City but have not been incorporated in the actual City code. Please contact the office of the City Clerk if there are any questions concerning the ordinances listed.

Ordinance No. 7797 - an emergency ordinance adopting Supplement No. 109 and other miscellaneous corrections and amendments as amendments to the Boulder Revised Code 1981, and setting forth related details.

Ordinance No. 7798 - an ordinance submitting to the registered electors of the City of Boulder at the Municipal Coordinated Election to be held on Tuesday, November 1, 2011, without raising taxes, increase the debt of the City up to forty-nine million dollars for bonds to fund capital improvement projects, and setting forth related details.

Ordinance No. 7799 - an ordinance submitting to the registered electors of the City of Boulder at the Municipal Coordinated Election to be held on Tuesday, November 1, 2011, the question of amending City Charter sections 12, 64, 65, 68, 72, 89, 101, 104, 105, and 108 of the Charter of the City of Boulder to reflect organizational changes in names of positions and departments, specifically including without limitation; to change the title of the Director of Finance and Record to Chief Financial Officer; to move the duties of the City Clerk to the City Manager's Office; and eliminate obsolete reference to the employee that was to take the role of City Marshall in the last century; and setting forth related details.

Ordinance No. 7800 - an ordinance submitting to the registered electors of the City of Boulder at the Municipal Coordinated Election to be held on Tuesday, November 1, 2011, the question of amending City Charter sections 120 and 151 of the Charter of the City of Boulder to change the penalty for violations of the Charter from $100 to the same penalty as other misdemeanors occurring with the City, and setting forth related details.

Ordinance No. 7801 - an ordinance submitting to the registered electors of the City of Boulder at the Municipal Coordinated Election to be held on Tuesday, November 1, 2011, the question of amending City Charter sections 5, 21, 27, 31, 32, 33, 34, 55, 56, 57, 61, 97, 97A, 98, 108, 124, and 164 of the Charter of the City of Boulder to clean-up provisions regarding election procedures and terms, and setting forth related details.

Ordinance No. 7802 - an emergency ordinance submitting to the registered electors of the City of Boulder at the Municipal Coordinated Election to be held on Tuesday, November 1, 2011, the question of amending City Charter sections 38, 38A, 38B, 39, 40, 41 and 42, all relating to the procedures for exercising the right of initiative by the people; setting for the ballot title; specifying the form of the ballot and other election procedures; and setting forth related details.

Ordinance No. 7804 (Light and Power Utility) - an emergency ordinance submitting to the registered electors of the City of Boulder at the Municipal Coordinated Election to be held on Tuesday, November 1, 2011, the question of amending City Charter to authorize the City Council to create a local utility and the principles for the operation of said utility for the distribution of electricity; authorizing the City Council to issue bonds for the acquisition of the distribution system and other assets necessary for the operation of the local utility; and setting forth related details.

Ordinance No. 7807 - an emergency ordinance submitting to the registered electors of the City of Boulder at the Municipal Coordinated Election to be held on Tuesday, November 1, 2011, the question recommending and amendment to the United States Constitution abolishing the rights of corporations to be protected as persons under the United States Constitution, and setting forth related details.

Ordinance No. 7808 (Increase and Extend the Utility Occupation Tax) - an ordinance submitting to the registered electors of the City of Boulder at the Municipal Coordinated Election to be held on Tuesday, November 1, 2011, the question of amending City Charter to authorize the City Council to extend and increase the Utility Occupation Tax that was approved by the voters in November 2010 and approved by the City Council in Chapter 3-13, B.R.C. 1981, on public utility companies that deliver energy to customers in the form of electricity and gas at the rate of up to $1.9 million dollars, beginning January 1, 2012, and expiring the earlier of: (1) December 31, 2017, (2) when the City decides not to create a municipal utility, or (3) when it commences delivery of municipal utility services; the extension of the existing tax being used to continue to support local government services, and the annual increase in the tax to fund the costs of further exploration of and planning for both the creation of a municipal electric utility and acquiring an existing electrical distribution system; giving approval for the collection, retention, and expenditure of the full tax procees and any related earnings notwithstanding any state revenue or expenditure limitation; setting forth the related ballot title; and setting forth related details.

Ordinance No. 7816 - an ordinance repealing and re-enacting Section 11-1-19, "Water and Ditch Rights," B.R.C. 1981, to address agreements for right of first refusal, purchase and sale of or ditch rights, and resulting adjustment of water budget; eliminate references in the Code to Silver Lake Ditch and Reservoir Company; and setting forth related details.

Ordinance No. 7820 - an ordinance amending Chapters 2-6, 3-9 and 4-20, B.R.C. 1981, changing certain fees, and setting forth related details.

Ordinance No. 7822 - an emergency ordinance adopting Supplement 110 and other miscellaneous corrections and amendments as amendments to the Boulder Revised Code 1981, and setting forth related details.

Ordinance No. 7824 - an ordinance amending Title 7, "Regulation of Vehicles, Pedestrians, and Parking," B.R.C. 1981, concerning regulation of vehicles and traffic and parking infractions, and setting forth related details.

Ordinance No. 7826 - an ordinance amending Title 9, "Land Use Code," B.R.C. 1981, regarding definitions and use standards for breweries, brewpubs, distilleries and wineries, and setting forth related details.

Ordinance No. 7827 - an ordinance amending Section 2-3-11, "Planning Board," B.R.C. 1981, to allow for appointment of temporary alternates to the Planning Board due to an appearance of impropriety or a conflict of interest under Chapter 2-7, "Code of Conduct," B.R.C. 1981, or an anticipated absence, and setting forth related details.
